Constitutional Conservative's Widow Fights Back Against Legal Stall Tactics
Erika Kirk is done playing games. The widow of murdered Turning Point USA founder Charlie Kirk has demanded a speedy trial for her husband's alleged assassin, calling out what she says are deliberate delay tactics by the defense team.
Kirk's attorney Jeffrey Neiman filed the motion in Utah's Fourth District Court on January 16, making it crystal clear that justice delayed is justice denied. The alleged killer, Tyler Robinson, still hasn't entered a plea or faced a preliminary hearing after months of legal foot-dragging.
Constitution Doesn't Protect Delay Tactics
"Nobody believed in the importance of the United States Constitution more than Charlie Kirk," Neiman wrote in the filing. "And although the United States Constitution guarantees criminal defendants many rights, it does not guarantee them the right to cause undue delay in the criminal justice process."
That's the truth right there. The Constitution protects the rights of the accused, but it also protects victims and their families from endless legal games designed to drag out proceedings.
Under Utah Code, victims have "the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant." Kirk is exercising her constitutional rights, and it's about time.
Defense Team Playing Games
Robinson's lawyers tried another stall tactic on January 16, requesting that prosecutors be disqualified because one prosecutor's child was at the campus event where Charlie Kirk was shot. Judge Tony Graf shut that down fast, telling the defense team they should have filed earlier instead of wasting everyone's time.

The Facts Speak for Themselves
Here's what we know: Robinson is accused of climbing onto a roof near Utah Valley University on September 10 and fatally shooting Charlie Kirk in the neck. After a two-day manhunt, Robinson turned himself in after confessing to his parents and a youth pastor.
The charges are serious: aggravated murder, felony discharge of a firearm causing serious bodily injury, obstruction of justice, witness tampering, and committing a violent offense in front of children. Utah County prosecutors are seeking the death penalty.
Robinson even confessed to his self-described transgender boyfriend in a text message, stating he couldn't tolerate Kirk's purported "hatred." This was a politically motivated assassination of a patriotic American.
